~File #2007-01-Application for a 1 lot Subdivision on property at 167 Lohse Road. ~(Map 52, Lot 28, R80 Zone). ~Owner: ~Darlene & Richard Jenkins; Applicant: ~Mike Marino (Received on 1/16/07, Site Walk 2/17/07 at 9 a.m., Public Hearing on 2/20/07, Continued to 3/06/07, Decision by 5/01/07).

There was not a quorum of commission members that attended all public hearing sessions.  File 2007-01 will be discussed at the next meeting.

File #2007-05-Application for a Special Permit for a Day Spa located at 333 River Road, Suite A. ~(Map 30, Lot 17, DC Zone). ~B&M Realty Trust owners, Michelle Kelley, applicant. (Received on 2/6/07, Public Hearing on 3/6/07, Decision by 5/1/07).

There was not a quorum of commission members that attended all public hearing sessions.  File 2007-01 will be discussed at the next meeting.

File #2007-07-Application for a 6 lot Subdivision located at 150 Clint Eldredge Road. (Map 12, Lot 20, 21.07 acres, R80 Zone). ~Owner/Applicant CE Road, LLC. ~(Received on 2/20/07, Public Hearing on 4/03/07, Decision by 6/05/07).

Public hearing scheduled for 4/3/07.

New Business

File #2007-09-Application for a Special Permit for a Martial Arts School located at 15 River Road (Map 5, Lot 3, DC Zone). ~AMPM Properties LLC, Owners, ~Daniel Arnini, Applicant. ~(Received on 3/20/07, Public Hearing by 5/15/07, Decision by 7/17/07). ~

M. Ellis made a motion to set the public hearing for File #2007-09-Application for a Special Permit for a Martial Arts School located at 15 River Road (Map 5, Lot 3, DC Zone). ~AMPM Properties LLC, Owners, ~Daniel Arnini, Applicant on 4/17/07.  R. Tulis seconded the motion, all members voted in favor, thus the public hearing is scheduled for 4/17/07.

File #2007-10-Application for Modification of Existing Special Permit to replace chemical shed with a cardboard compactor and light bulb recycling shed at 49 Hancock Road (Map 38, Lot 20, R80 Zone). ~Town of Willington, owners/applicants. ~(Received on 3/20/07, Public Hearing by 5/15/07, Decision by 7/17/07).

Karl Acimovic and Lynn Nichols were present to discuss this application.  They explained that the chemical shed at the transfer station will be replaced with the one behind the garage.  N. Gray asked what is happening to the old chemical shed.  Ms. Nichols said that she will be bringing it up to code so it will be designed to hold chemical materials such as grease, oil, and hydraulic fluid.  Ms. Nichols said that the current shed does not allow for 100% containment.  

Mr. Acimovic went on to explain that the there will be a new storage shed for universal waste.  Ms. Nichols said that the DEP requires that this shed be covered and be a place to collect items such as electronics and light bulbs.  

Mr. Acimovic said that the transfer station is also here to re-apply for their permit.  He said that they will be doing some safety modifications including putting up a safety railing with four foot posts and two inch rails.  Ms. Nichols said that they would like to turn an old plow blade into a sign for the transfer station.  The commission discussed the size of the plow blade and looked at the regulations for sizes of signs.  They found that if the town seal is the sign then there are no size requirements.  Ms. Nichols said that was not the original plan, but they have no problem putting the town seal on the plow.  

R. Tulis looked at the site plan and noticed that the household hazardous waste building was missing.  Mr. Acimovic said that he will add it back into the plan.  

The commission discussed the bulk waste container.  Ms. Nichols said that they are trying to eliminate using the backhoe.  P. Nevers asked why they do not use the compactor for the bulk waste. Ms. Nichols said that it is too difficult due to the variety of materials that are placed into that bin, especially mattress which you can not compact.  

Jim Poole asked if he was able to comment on this application.  The commission said that he could.  Mr. Poole said that he feels that the commission is in violation of the Freedom of Information Act as this application is being discussed with out a public hearing.  G. Jones said that they have always listed items on the agenda with a time frame stating they will have a decision by or public hearing by a certain date. Mr. Poole said that he was concerned that the residents will not have an opportunity to respond or comment on this application.  R. Tulis suggested changing the agenda wording to “decision or public hearing by”.  

R. Tulis made a motion to approve File #2007-10-Application for Modification of Existing Special Permit to replace chemical shed with a cardboard compactor and light bulb recycling shed at 49 Hancock Road (Map 38, Lot 20, R80 Zone). ~Town of Willington, owners/applicants with the following conditions:
The town seal is placed on the plow sign
Household Hazardous Waste Building is put on the plans

Marco seconded the motion.  All members voted in favor of the motion, except P. Latincsics who abstained as he arrived half way through the presentation.

Public Comment
Jim Poole stated that the Fish property was being developed and they have begun a clear cut.  Mr. Poole also asked if the negotiated agreement from the Crossen case come in yet.  G. Jones said that it had not.

Adjournment

M. Ellis made a motion to adjourn.  P. Nevers seconded the motion.  All members voted in favor.
